A SERIOUS CHARGE.

ACCUSED COMMITTED FOR TRIAL. At tho Police Court on Saturday morning, before Mr. W. A. Barton, S.M., ivorman Marlow was charged with, on or about February 9th, that ho did wrongfully have carnal knowledge of one Agnes Mischowski, the said Agnes Mischowski being under the age of 16 years. Sergeant Hutton conducted the prosecution, and accused was delonded by Mr. T. Alston Coleman., Agneii Mischowski, daughter of John .Mischowski, laborer, of Taranaki, st.ited that she had boon residing with her sister, Mrs. Annie Treves, in Russell street, since January. 1907. She had known accused since December, and ho had been in the habit of coming to her sister’s house. In February her sister went to Auckland, and it was during her absence tbit accused became intimate with her.

To Air. Coleman: She was quite sure that accused was the man who hail been intimate with her. iS'lio did not like to tell any person, but her sister. Later, howovor, she told the policy of the occurrence, after accused had been.charged with theft. . Annie Troves said that before sho left for Auckland, she gave accused permission to visit her sister during her absence. Shortly after her return, witness, in consequence of an admission made to her bv her sister, taxed tile accused with having committed tho olfoiico. Accused mado no reply, and witness ordered him off the premises. Her sister was 15 years old, this month, and was born in Midhurst, Taranaki. Evidence was also given by Patrick Hofon.'

Sergeant Hutton produced a copy of the birth certificate of Agues Miseliowski, which had been received from tho Registrar-General at Wellington. . Accused pleaded not guilty, and was committed for trial to tho next sittings of tho Supreme Court at Gisborne, bail being allowed.
