FORWARD DELIVERY OF SHEEP. SELLERS FAIL TO KEEP THEM IN CONDITION. AN IMPORTANT CASE. ..Press Association. TIMARU, Dec. 5. . An important case lias just been decided here in connection with a sheep deal. H. Woodley sued Campbell 8r05... Geraldine., for £SOO damages for failing to look after 3000 lambs sold by defendants to plaintiff for forward delivery. The sale was made last year, just before the drought, and defendants- claimed to have done all that possibly 'could bo done to keep the lambs in condition. Prices fell, and as Woodley failed to take delivery, at the specified time, the Campbells resold the lambs at his risk, successfully claiming on him to make up the difference (£1057) between the prices realised at this sale and what Woodley had agreed to pay. Woodley now claimed £SOO on the ground that the Campbells failed to comply with the terms of the sale agreement. The case was hoard before Mr. Justice Haselden, who gave a. verdict for defendants.
