But recently it- had to bo described in affidavit, language in the iN.S.W. Equity Court, and this is whiart it appears as:—“Tho said helter-skelter of the plaintiff co. is an amusement structure, from which visitors descend by sliding down, usually on a mat, by gravitation, an inclined curved trough, leading from the top of tho said structure partly round and partly away from tho same.” The owners claimed that the “Alpine slide” of a rival showman was really the same thing, viz;., “an amusement structure” etc. The Court agreed that for tho present tlio helter-skelter is an Alpine slide, and an Alpine slide a helterskelter, and granted interim injunction.
