COURT OF APPEAL.
I/ess Association. WELLINGTON, last night. Tho Court of Appeal was engaged to-day with Hex v. FstfUc, who was tried recently at Napier for assaulting the Sheriff. At the close of evidence for the Crown,. Mr. i . -tj. Ba'ume, K.C., counsel for prisoner, contended that prisoner must be acquitted on the grounds—(l) thero was no proof that the conditio. l as to payment of purchase money had been fulfilled, therefore the writ of possession was bad; (2) there was no proof that Cutten was Sheriff at the time of the assault; (3) that there was no cvidenco of identification cr the land, therefore Cutten was trespassing and tho assault was justiiiable.' Prisoner was convicted bv a jurv and Mr. Justice Cooper reserv - ed for the opinion of the Court or Appeal the question whether lie was rightlv convicted. Mr. Baunie K.C., and Mr. Levi appeared for the prisoner, and Mr. Myors for the Crown. M.' Bamne stated the facts . as above referred to and the evidence. His address was not concluded when tho Court adjourned until 10.30 tomorrow.
