EXPENSES OF A RACEHORSE

:lonce, yesterday morning in the case a tlio Magistrate’s Court between Arthur William Adams, horsetrain;r and jockey, and Edward Pardoe, nvner of llih horse Huria. £34 11s id was claimed for expenses, travelin, feed, etc.- .

Mr. Bright appeared for plaintiff ul Mr. Stock for defendant.

Mr Bright explained that this was i claim for the expenses of the racehorse Huria, at- 37s per week for 27 weeks. Plaintiff in liis evidence said that

he was a horsetrainer and a jockey. On 31st Oct. last entered into the arrangements. Previous to .this defendant asked bis opinion about the

liorso and wanted a quotation for training, and witness said the lowest price lie could do it for was 35s per week. About a week later, witness agreed to fia'ke a filly, and train the two for 30s a week each, but lie decided not to put the filly to work. The horse was taken away by defendant’s brother on the 24th April, and me week’s pay in lieu of notice was also claimed. Defendant- told him

bout a fortnight before that he

would put tho horse lip for sale by auction. Witness took the horse to ((lie sales, and it was not sold. Then took it at defendant’s request to Tolaga Bay. Rode the horse at Waipiro and claimed £l, the proper fee, which was unpaid. Made all expenses as light as lie possibly could. By Mr. Stock: Was at the Park races last February. Received £5 from defendant as a present for wiving him iniforinatioi). and agreed to give 'him iniformation concerning the horse. ..

• Commonly Called a - “tip” -interrupted the Magistrate. “Yes” replied Witness. Pardoe, said to him,

“I suppose you. will tell me when the horse is likely to win.” Witness said lie would. "When paid defendant said, “Tliats yours, for yourself.” Nothing was said as to his getting any hare of the winnings. He could

not accept such terms. It was the common arrangement with jockeys. Tbis'-was not even proposed to him. The usual fee for traimg a horse was anything from two or three guineas. Defendant. did not tell witness after the Tolaga races that his services were required no further, and he did not instruct him not to take the horse back to Waipiro. Kept the horse in f training at 'Waipiro. He was under the impression that defendant. would "ut another horse under witness’ care.

By Mr. -Bright:"The tip given by witness was very successful. Defendant and his brothers got £4O or £SO out of it according to their own statements. The £5 was given before the race was run. Thomas McGuire, a trainer, considered that £2 was a reasonable fee for training. -By Mr. Stock: Got £2 a week and 10 per. cent of the winnings. Mr Stock stated that the arrangement was that plaintiff should have a share in the winnings. He was tpid his services would not' be needed, but after that ho took the horse to Waipiro against instructions. The £o was given on account of wages. : Defendant- deposed that he was a dairy farmer, and that he and his brother owned liuria. Adams wanted to train the horse and saw him about it, offering to train it at £1 a week and half the winnings. Nothing was said about paying 35s a week. Agreed to the terms. Took the horse to Tola go and said nothing about proceeding to Waipiro. Told him that agreement would terminate and the liorse was taken out of his care in July. Was at the Park Paces last February, and upon his request lie gave Adams £5 in t'lie presence of witness’ brother. What Adams said about the tip was not correct. By Mr. Bright: We never contemplated putting two horses into training. His brother owned a filly, hut as far as lie knew, did not intend training it. Was certain- tliaft no conversation took place' ahtlie'auction mart about training the two horses for 30s each. Was not at Tolago at the time of the races. piro, but be did not give a reason. Plaintiff, recalled, said he saw defendant at Waipiro. Edward Paidoe paid the entrance fee to the secretary.

His Worship took it that the agreement was that Adams should receive £1 and half the winnings. There were no winnings and therefore plaintiff must be content with £1 per week. £1 also was due in lieu of notice. £3l Is was due less £l9 agreed to. and £5 paid in cash, leaving a balance of £7 Is, and judgment would he for plaintiff for that amount, costs at- £3 being allowed.
