A case wherein the qxxestion as to what constitutes a public place xx’as before the Polico Court to-day. Two men wore charged with disorderly conduct in the main passage of an hotel.

Counsel held that the only “public place” in a hotel was the public bar. The definition of a public place xvjis controlled by the words, “as of right.” Only persons seeking accomriiodation or refreshment had a right in the passage. If the main passage of an* hotel was a public place the whole of the hotel was so. The Benclx held the contention to be a good one', and dismissed the information, holding that the offence, if any, bad not been committed in a public place..
