Judgment was given by Mr Justico Cooper to-day-in the appeal by Mrs. Weiss against a conviction for having sold Now Zealand wine containing a greater quantity of proof spirit than sho was authorised by her license to soli. His Honor hold that it was not necessary for the prosecution to prove knowledge, on the part of defendant, nor did her absence of knowledge oxculpato her. Tho defendant’s liconso authorised her to soli Now Zealand wino containing not more than 2u per cent, of proof spirit. Sho sold wino containing appreciably moro than 20 per cent. Sho therefore sold liquor sho was not authorised by her liconso to sell, and could not oscapo the consequences of that illegal sale. It was contended that sho suffered hardship, as tlio producer represented that tho wine did not contain moro than tho authorised amount of proof spirit. His Honor answered that sho had her remedy against the manufacturer. Tho appoal was dismissed, with seven guineas costs.
