A charge of theft of some timber (the property of Messrs Evans, Nield and Co.) was preferred against Albert \V. Jaggers in the Police Court before Mr Barton, 8.M., yesterday morning. Mr Alston Coleman appeared for the prosecution, and Mr G. H. Lysnar for the defendant Mr Lysnar admitted that accused had utilised the timber in

the making of certain doors, but denied

the intention to steal. Evidence for informants was given by Mr Nield, who said that Jaggers had been foreman carpenter until he was taxed about taking the timber, which had been removed from a house the firm were building for Mr F. J. Rowley ; nothing had been said about it by accused. William Pilcher, of Pilcher Bros., butchers, said he had made arrangements with accused and two others to make two doors for his firm’s shop. For the defence the accused, William Johnson and Alexander Bain, carpenters, gave corroborative evidence that though the timber alleged to have been stolen had been utilised to make the doors in question, and was the property of Messrs Evans, Nield and Co, it was the intention to pay for the timber out of the wages the following pay day. His Worship said that no doubt there were suspicious circumstances, but there was a doubt, and he would give accused the benefit of it.

The accused was discharged. In the Magistrate’s Court yesterday before Mr Barton S.M., a first offender for drunkenness was fined os and 2s costs or 24 hours’ imprisonment. Ada Hamson, alias Mabel Millar, who had a previous conviction against her, pleaded guilty to drunkenness and was fined 10s and 2s costs or 48 hours. Charles Omarei alias Daniel, pleaded guilty of being drunk. Mr Finn asked his Worship to take into consideration that defendant had been in the lockup since Saturday and also that he would ask for a light penalty, as Omarei would leave the district. His Worship said he must fine the accused something, but under the circumstances mentioned by Mr Finn he would make it comparatively light. To defendant:

“ You’re fined 10s with 2s costs or 48 hours, and mind you don’t come here again.” “ Thank you ; God bless you, Sir, and good luck to you 1, replied defendant as he left the box.
