SALE OF SHEEP.
A case of considerable interest to sheep' farmers was beard at the Magistrate's Coart yesterday before Mr Barton, S.MWilliam Pioken, for whom Mr T. Alston Coleman appeared, Bued Owen Edwin Bertram (represented by Mr W.D.Lysnar) for £47 10s, alleged to have been the loss sustained through a line of 200 Bomney sheep sold by the Loan and Mercantile Agonoy Co., at their stock sale in February last, on behalf of defendant as five years old, and whioh Mr Pioken purchased at 12s 9d per head (£127 10s). For Ihe plaintiff evidence was given by Messrs Pioken, D. Dobbie, Thomas Spenoe, and J. B. Kells, while for the defenoe Messrs Bartram, 8. C. Care, A. Moore, and J. W, Blight were oalled. The evidenoe for the plaintiff tended to show that the sheep bad been tiken as being five-year-olds, and subsequent examination showed that they were a good deal older, in which ease the value would be considerably less. Mr Bright stated that Mr A Biohardson, an expert, had purchased the remaining lot of the sheep at the sale, and had since expressed himself the reverse of dissatis* fied. Mr Lysnar submitted that no loss had been shown, and that the price was a fair marketable value at the time. To enable the oase to be finished and witnesses who had oome a long distaooe to be released from attendance, His Worship sat until 530 p.m. and then resumed at 7 o'olock. The case was concluded about 815 p.m., judgment being reserved to enable His Worship to oarefully analyse the evidence.
