The Appeal Court is hearing the case of Hamilton Gilmer versus Elizabeth Crawford, asking for specific performance of covenant which had been entered into with defendant for renewal of lease of the Te Aro hotel, Wellington. The application was resisted by respondent upon tho ground that the lease was executed after the passing of the Alcoholic Liquor Sales Control Act, 1895, and contained a covenant binding the hotel to T. G. McCarthy, and as the covenant was voided under that Act, the Court would not grant specific performance of the renewal clause of the lease. Plaintiff’s contention is that the effect of the 1895 Act was to requiro the Court to read the lease as if the binding clause was not in it.
