The qnoslion as to. whether a police constable is personally liable for his own aots or whether the Government, wbioh employed him, is responsible, has been dealt with in the Federal Court. Plaintiff obtained a verdiot in the lower oouct of Tasmania against tbe Government for wrongful arreet. The Full Court quashed the .verdict. An appeal to the High Court confirmed the Full Court's deoisioD, holding that authority to arrest was not oonforr.-d upon the Government, nor exeroised on behalf of the Government, but was conferred on the constable as the bolder of a public offioe, to whioh well-known duties and responsibilities were altaohed.
The arrest was made in the discharge of his duty as a holder of the offioe of constable, enl not by direo.tiohvor under tbo oontrol of the Government. The relation of master and servant between the constable and tbo Government could not be implied.
