Ho said that Maloof’a oartifioato of exemption should have been signed by tho Minister and the Oollooior of Customs. During the absence of tbs Collector the certificate was signed by the ActiDg-Oolleotor, who had not bona appoint.d to sign certificates. Therefore the certificate was invalid, and tho case was dismissed. Malouf was then proceeded against on the aeoond ohargo, of not having left the State on tho expiry of the seoond exemption certificate whioh ho bad obtained.. Evidence was given showing that Malouf had passed tho test in -Eoglisb, but was unable to write out in Frenoh or German. Tho defohoe olaimed that tho tests were made in auoh a way as to be faroioal, and that there was no case to answer. Tho hearing was adjourned to Friday □ext.
