In connection with the slander action W. and A. Maoarthur and Company against Sir Wm Lyne, claiming £SOOO damages, an application wbb made on behalf of plaintiffs for a special jury of twelve. Counsel for defendant opposed the application, and asked to be tried by a common jury. The Chief Justice, delivering the unanimous judgment of the court, and granting a special jury, said that if any oase heard in the State rci many years p«t required a special jury it was this, one sida being a leading firm of merchants and the other Federal Minister of Customs. The Minister was alleged to have charged ths firm with gross fraud in selling goods and under false pretences. If the charge was brought home to them, it would effectually damage their oharaoter for all time as a firm.
Tho hearing was fixed for the 19th March.
