Boss, tobacconist, for failing to comply with the early do ing law. that a requisition was presented to the Minister by a majority of tobacconists of the city in favor of obse ving certain hours, and in accordance with the Act the Minister issued a Gazette notioo. Ross and others failed to observe the hours. The defooos was that the requisition was not signed by a majority of tobacconists who were tobacconists only, bnt that the majority was made up ot Chinese fruiterers and h .ltdreesars wbo sold tobicco and cigarettes. The order, therefore, was bad. The P argued that although some of those who signed the requisition carried on o.ber businesses as well ns those of tobacconist, still they were tobacconists. Judgment was reserved.
