A DISHONORED CHEQUE.

Judgment was given to-day 'by the Chief Justioe in the case in which John Charles Jones sued Frederick Hilton, a tutf commission agent) for £42, amount of a cheque drawn in favdr Of John McWilliams, paid by the latter to Jones, and subsequently dishonored by the-bank on account of payment being stopped by the defendant Hilton.' Hib Honor-, said hs was of opinion from all the circumstances,' especially from the relationship between plaintiff and MoWilliattoa, that it was not an honest transfer of '» cheque from McWilliams to him. and that plaintiff took the cheque knowing that it bad been dishonored, and knowing there‘was something wrong with the cheque. It was dear Mo Williams was really suing, Jones lending his name in order to try and reoover money won by-: McWilliams from the defendant. The relationship between plaintiff and McWilliams showed thst plaintiff ought to have known it was not a j bona fide transaction; 7 Judgment would go for defendant. Defendant, aB well as McWilliams, had been engaged in an I illegal transaction, but he did not know if that was -uffioient to • warrant him in refusing Hilton obstß' altogether. Were he to do so it migbt enoourage those who have no claim whatever, because of anillegal transaction, ,in bringing such an action in Court. Defendant would be allowed £1212s costs, witnesses' expenses, and disbursements. The dooumente la the case were ordered to be impounded.
