In giving judgment, Mr Turnbull, S.M., said : 11 Plaintiff alleges that defendant lit a fire for tbo purpose of burning felled bush, which spread and destroyed and damaged plaintiff’s tramways, fencing, and grass, I find that defendant did actually light a fire as alleged, aod that the fire caused other fires in the lands occupied by plaintiff, and did damage to the latter’s tramways, fences, and grass. It is well settled law that under these circumstances defendant is liable to damages. The aw of New Zealand is that if a person lights fires on hie own land he must at his own peril pre. vent them from spreading to the land of his neighbor.
