A WAIKATO CASE.
THE FOURTH TRIAL,

The fourth trial of Herbert Penson upon a'charge of committing a criminal assault upon a marriod woman named Beuth at Cambridge on October 6, 1904, was continued before tho Chief Justice to-day-Evidenoe was given by Dr Roberts, a stable hand named Dwyer, and James McVeish, This concluded the base for the Crown. In opening the case for the defence, Mr Lundon said he would call evidence to show that Poaaon went to Mrs Beuth’s house by araa gement, and that there had beon aots of impropriety before. Peasou corroborated what Mr Lundon had said, giving practically tks same evidence as he gave upon the previous occasion: In regard to the penny produced beating the initials “L. B. H. P.,” Peason said that upon one occasion Mrs Beuth exchanged coins with him. He gave her a threepenny piece, while she gave him a penny. Upon his penny he got engraved tho initials “L.B. H. P.” In reply to tho Crown Proseoutor, prisoner said that he had this penny at the first trial. "It was one of the things taken away from him in gaol. The Court adjourned. Later. —The evidence was concluded at 10 p.m. Counsel will address the jury to-morrow.
