An interesting point was raised by. Mr Skelton at the .Police Court during the hearing of. a charge of assault preferred by. Ah Poo, a Chinese cook on the cable steamer Iris, against three countrymen employed on the same vessel as firemen. Mr Skelton held that the. Court . had no jurisdiction in the case, on the ground that life vessel was nqt a merchant ship, but belonged to Ilis Majesty, 'the men. employed thereon being consequently under the control of His Majesty,. Mr W. J, Napier, who appeared for the prosecution, contended that tnc vessel was not under the control of His Majesty, 'hut was. controlled by tho Pacific Cable Board, and that the Count consequently had power to deal with the case. Mr S. E. McCarthy, who presided, said the point was a very interesting one, but one that lie would leave to a Supreme Court judge to decide when the case reached a higher tribunal.
