LAWSUIT OVER LAMBS.

(Per Press Association.) Dunedin, last night. The Chief Justice delivered judgment in the action F. Neill, of Waikouaiti, against John McCarthy, of Prebbleton, Canterbury, claiming £2OO damages for alleged breach of agreement to purchase 800 lambs. The defence alleged misrepresentation as to the date of lambing, and the point was raised that the written agreement did not disclose the subject of the contract, and under the Sales of Goods Act it was not binding. The Chief Justice gave judgment for plaintiff for £IOB, but held that plaintiff could not recover for alleged loss during the month which elapsed between the date delivery was to have been taken and the sale of the lambs.
