APPEAL COURT.

.THE PACKET LICENSE CASE.

Per Press Association

WELLINGTON, last night. In tile case ol Norwood v. Stuart, which involved the right to sell liquor upon a river steamer going for a short excursion, the Appeal Court upheld the appeal, and ordered the case to be remitted to the Magistrate, with the opinion of the Court that there should have been a conviction.

In th» other packet license case, wherein the right to sell liquor on that part of the Wanganui river which within the prohibited native district is sought to be upset, the Court was unanimous that such license does not come within the meaning of the section of the Act prohibiting the sale. The rule nisi was discharged with costs. The Court of Appeal this morning dealt with an appeal to dispauper appellant in the Wellington case of Sainsbury v. Teare. Sainsbury obtained leave to appeal to the Court of Appeal in forma pauperis from the judgment of the Chief Justice. The Court now made an order dispaupering him, on the ground, amongst others, that he appeared he was worth more than £25. In the case of Rex v. Badger, the Appeal Court held that the letter was capable oi ■being taken as a charge of forgery against the solicitor referred to, and was libellous, and not privileged; also that the Magistrate’s order giving leave to prosecute was sutncient. The Court also commented on counsel’s method of conducting the case before them. The conviction Was affirmed. The Court was further adjourned until Thursday,.
