RECENT BOROUGH ELECTIONS.

FORFEITURE OF DEPOSITS. Mr W. J- Quigley, Returning Officer, wrote to the Borough Council last night that Mr A. F. Kennedy had been elected to fill the vacancy caused by the resignanation of Mr R. N. Jones. Acccordiog to law the deposits of the two lowest oandididates were forfeited, and it was for the Council to deal with them.

Mr Taylor wrote“ I hereby respectfully request the refund of the amount of my deposit of £3, paid in connection with the last election of councillor, for which office I was a candidate. As four names appeared on the ballot paper issued by the Returning Officer after one of the candidates had retired from the contest, 1 consider I was placed in a position not anticipated by me and my supporters, inasmuch as if the whole number were in the field the splitting of votes would in all probability have increased the percentage of Votes recorded in my favor. I will enI tirely rely upon the sense of juatioe of your Council in this matter.” The Mayor said it was a question that did not concern the Council at all; it was laid dawn in the Act, and the Council had no option in the matter. The Colonial I Secretary should be applied to. In reply to Cr Hepburn, the Clerk said a candidate must poll to one-eighth of the lowest successful candidate. In Mr Taylor’s case the number required would be sixty-one. Cr Morrison : We have no power in the matter. Cr Harding : We oannot interfere with the Act. In reply to a question, the Town Clerk said that Mr Matthew’s deposit would also be forfeited, as he had not sent in his resignation, but he had not made application for a refund.
