By Telegraph—Press Association. Wellington, Saturday. The Chief Justice to-day gave judgment as to the right of Brown, an exprisoner, to sue Dr Teare, gaol surgeon, for L2OOO damages for alleged unskilful treatment while in gaol. The defence contended that the action was prevented by Statute of Limitations, over six years having elapsed, plaintiff having been a prisoner in gaol during that period. His Honor held that plaintiff was civilly dead while in gaol, and Statute of Limitations could not therefore ; apply.
