CLAIM FOR DAMAGES.

At the Magistrate’s Court yesterday, before Mr Barton, S.M., A. J. Cooper sued G. H. Adams for £45, damages on account of a broken leg causod by the plaintiff as a result of a blow from the defendant. The matter had already been before the Court and defendant fined £lO, and this was a civil action for damages. Mr Nolan appeared for the plaintiff, nnd Mr DeLautour, with Mr R. N. Jones, for the defendant. Plaintiff stated that ho had received £ls from the defendant, but that Mr Gault, who received it for him, was not entitled to give a receipt in full, as he had done. The cross-examination went to show that Mr Gault had, after a conversation betweon plaintiff and defendant, been instructed to get £ls from defendant, and that subsequently Cooper had lifted the money and made use of it. Mr DeLautour applied for a nonsuit on the ground that Cooper was bound by the agreement, and if, as had been alleged, Mr Gault had not the authority to settle the matter, plaintiff had ratified his action by accepting the money; and further, that plaintiff could not still retain the benefit of tho £ls, and try to sot asido the settlement.
