WADE'S PATENT.

JUDGMENT FOR PLAINTIFF. < Special to Timks.) Wellington, Saturday. The Chief Justice delivered judgment on Saturday in trie case brougnt by Ballinger Bros., of Wellington, against the rival plumbing firm of Thomas Ballinger and Co. for infringement of the skylight patented by Mr Wade, of Gisborne, of which plaintiffs are the assignees. Mis Honor heid on the facts adduced in evidence that the defence of want of novelty in Wade's patent was not proved. That the claim of specification was for a combination and not for an individual ; party, and that the skylight manufactured ; by the defendant and known a* Bedell j Mid WeDby’s patent was an in- I fringement of Wade's. In substance ! tne pith arid marrow of Wade’s invention had been taken by Bedell and ; AVclsby’s skylight, which defendant had j constructed. Judgment was given for the j plaintiff’s. Incidentally Mis Honor ro- j grefcted that the Court had not the assist- j ance of mechanical experts in dealing j with cases of this nature, pointing out j that it had such assistance in dealing with j the values of the land, and the questions here were inure difficult of decision. The question of the damages for infringement and costs was reserved, His Honor expressing the opinion that, as it had been a difficult question to settle and not entirely free from doubt, ho thought the plaintiff should deal lightly with tlio defendant, it is understood that the parties would ■ fiottlo tlio amount of damage. The defendant was allowed a month in which to j ' consider whether lit* would appeal. 1
