LAWSUIT STILL PROCEEDING.
(Special to Times.) ' ',’ellington, last night. The case ain .ng the relative merits of the two pate . sir nghts, and involving the question a wi outer that of Hetle'l and 'Welshv, of , ,'ellit gtoo, is an infringement of that o f Mr Wade, of (lisborne. is still dragging along ai tho Supreme Court. The licensees of Wade’s patent contented themselves with calling one witness, and then let the other side proceed with tite attack on the patent, which they did through the medium of a score or so of witnesses, in the effort to prove that metal skylights have been known in the colony for the last twenty years, and that Wade's patent is no novelty. Evidence is now being called in rebuttal.
Counsel defending Wilde's patent said that it supplied a long-felt want, and was nrueh in demand. Bedell and Welsby came into the market five years later, and because Wade claimed his to be a novelty the colony had been ransacked from Auckland to the Bluff to discover skylights resembling it. Only ono of the number exexhibited in Court in any way resembled the two in contest, and the model of that was constructed after the previous Court ease, although the designer claimed to have sketched it out sixteen years ago. Authorities were quoted for the purpose of supporting the claim for an invention as a whole, and not merely for a particular part. Judgment will probably be reserved.
