JUDGMENT FOR PLAINTIFF IN MATEROA v. FINN. (Special to Times.) Auckland last night. In the Supreme Court to-day Judge Conolly gave judgment in the Materoa v. Finn case. He decreed that the transfer from Bennett to Finn and Finn to J. Baty be declared fraudulent against Kataraina Kahutia and against plaintiff as her administrator and successors, but Finn be decreed trustee for the plaintiff of £875 received from W. J. Baty ; that Finn render plaintiffs forthwith all accounts against the estate of Kahutia ; when the bills and costs are settled, Finn to pay plaintiff the difference between that amount and .£875, with interest. Defendants" to pay oosts of-this action on the highest scale. A second judgment was given, in the case of Mere Roilii and others v. the Assets Company. The action was dismissed on the ground that all the plaintiffs now submitted they could have acted as plaintiffs in the former case, had they chosen to do so, having a common interest ; that the actions were vexatious and an abuse of the Court. Costs 10 guineas were given in each case.
