Mrs Smith, in her statement, gave as a reason for not bringing hor friends over here as witnesses that tho trouble was quito bad enough for horsclf and husband.. Tho judge’s summing up was strongly against the accused. There was not, ho-, said, a tittle of evidence to show that; deceased took a tonic, and no support of the theory of defendant’s counsel of ant aggregation of poison. At 10 to-night the jury wore unable to-> agree upon a verdict, and wore looked upfor the night.
