A decision given by Mr Greenfield, at Levin, is of considerable interest to road boards ,and other public bodies* The Wirildno Eoad Board sued Mr Campbell for JEIB, being the amount expended by the Board in cleaning out the part of the Koputaroa stream which passes through Mr Campbell’s property. _ It was alleged that proper notice was given Mr Campbell to do the work in question, and that on account of his default, the Board, in accordance with statutory power, did the work and charged it to Mr Campbell. After the claim wa3 heard, Mr H. S. Fitzherbert raised as nonsuit point the fact that as the word “ service ” is used in the Act the mere posting of a notice unregistered is insufficient evidence of service. This point was upheld by the Bench, and the plaintiffs were nonsuited, as their cause of action depended entirely on proper notice being given. The decision means that personal service is necessary.
