AN ABSCONDER.
THE SURETY IN TROUBLE. [UY TELEGRAPH —PRESS ASSOCIATION.] Dunedin, last night. 11. [J. K. Alassey Lawless appeared before the Supreme Court to-day, under a writ of fieri eapiasi. Defendant went bail for a man named White, who absconded prior to the last criminal sitting, and, having failed to pay the £IOO bail, vjA arrested, and detained in custody, 1 Air A. K. Barclay, for tho defendant, contended that the Act and the form of writ did not authorise the further detention of Lawless in custody. The writ was entirely unknown in English law. Air Justice Williams said that, as far as lie know, this was the first time the question had boon raised, and he thought the matter should stand over for a day to enable tho Crown to investigate the facts. He presumed that the Crown would not be able to detain tho defendant if iio really had no means of paying tho debt, but the question must bo considered if defendant could be further dealt with, if released, under tho writ. Tho case was, therefore, ordered to stand over for the day.
