HARBOR ELECTION.
(To the Editor of the Times.)
Sir., —As there seems adiversitvof opinions as to whether the result of the Stipendiary Magistrate’s decision in connection with the recent petition docs not declare the whole of the last Harbor Board Election void, I would suggest in order that the matter may be cleared of doubt, and thus any further litigation saved, the Mayor or Harbor - Board take the opinion of, say, the Crown law officers at Wellington on the following points: —l. Seeing that an irregularity has occurred in the proceedings, which, in the opinion of the Stipendiary Magistrate tended to defeat the fairness of the election, is not the whole election —that is the election of the town and country members —void ? 2. As the Harbor Board Act of 1878 says that every member of the Board shall conic into office on the day of his election or appointment, and shall cease to hold office on the day his successor comes into office, was Captain Tuckor a member after the date of the last election, and if the whole election was declared void, are Messrs Cooper and Hepburn still members of the Harbor Board ? Did they not cease to be members after such election was declared void ?—I am, etc., Frank Harris. P.S.—Perhaps some of your legal correspondents could give an answer to the above queries.—F. H.
