Contracts.

A long discussion took place at the Borough Council on Tuesday night, on the subject of contracts.

Messrs'' Maxted and Co. wrote stating that they had made a mistake in regard to the measurement of the .fencing on the Waikanae. Crs Kennedy" and Hepburn thought that as the tender had been for a lump sum they could not give more.

Cr Joyce moved and Cr Jones seconded that the amount be paid, as they considered it only honest.

Cr Lewis said that Maxted and Co. tendered on the Council’s measurements, and ought to be paid if there was a mistake. Cr Johnston said that the job had been tendered for on a lump sum. Cr Jones said they would find out their position quickly if the matter were taken to Court.

The Mayor said that if the tenderer had taken the trouble he could easily have measured the work; it was a case where the contractor had made a mistake and wanted the Council to pay. Cr Harding moved that the specifications be carried out. ; Where a man tendered by specification would it be fair to the other tenderers to pay the extra sum asked ? The proposition to make the payment was lost, Crs Joyce, Jones, and Lewis voting for it.
