Motion Dismissed

A motion to rescind an order for possession of a house in Salisbury road was dismissed to-day by Mr. A. Coleman, S.M., in tire Magistrate’s Court. The evidence was heard yesterday, the Public Trustee being represented by Mr. J. D. Kinder. The defendants were Mesdames T. Gray and Blanche Thomas. Mr. J. deV. W. Blathwayt appearing on behalf of Mrs. Tihomas. Mr. Blathwayt said 'that his client had had three notices to quit and an order for possession Was under consideration. He contended that the position had been altered by this year's amendment to the Fair Rents Act, which brought flats in buildings not originally designed as flats within the scope of the principal Act. Mrs. Thomas gave evidence. Mr. Kinder said that Mesdames Gray and Thomas had taken out a joint tenancy and no change in the tenancy had been made, although it had been found later that the two were paying their portions of the rent separately. Sydney Robert Massam, a clerk in. the Public Trust Office, also gave evidence.
