Breach of Award
Judgment for the plaintiff for £2 and costs was allowed this morning by Mr. A. Coleman, S.M., in the Magistrate’s Court in a case in which the inspector qf awards, Mr. G. McKessar, proceeded against Spencer Brothers, Trulife Studios, Gisborne, claiming £lO as a penalty for a breach of the New 'Zealand retail shop-assistants’ award by employing a worker, Edna Halliweli, between April 17 and July 1, 1939, and failing to pay award rates. Mr. L. T. Burnard appeared for the defendants. Mr. McKessar said Hie girl was entitled to £1 5s a week af first and £1 9s later, but she had been paid only £l. The defendants had refused to pay more, although several times requested to do so. Miss Halliweli said she had been working previously for 10 months, and was in her third six months of service when she went to Spencer Brothers, Crossexamined by Mr. Burnard, she said no wage had been arranged before she started work an<J she received the same amount as the girl before her. She had mentioned her previous experience, but had not complained about the amount of her earnings.
