FINE OF £75 IMPOSED
GAMING ACT BREACH
COUNSEL ATTACKS LAW

Pleading guilty to a charge of keeping premises as a common gaming house, Joseph David, a restaurant proprietor, was fined £75 and costs in the Pahiatua Magistrate’s Court yesterday. Mr. Siddells, for the accused, entered a plea for leniency. He stated that David might have difficulty in paying the fine because the previous day lie had enlisted for active service.
“We have the ludicrous position of Ihe Government permitting gambling by art unions, yet repressing the gambling activities of those unable to attend race meetings,” he said. “No matter what penalties are imposed, another bookmaker socn arises and takes the first one’s place. It seems to me that this state of affairs will continue until the Government sees fit to alter the legislation by permitting ofl'-the-coursc betting.’’ David had been previously convicted, in ’1938. ’Mr, Siddells askecl a similar penally be fixed, £25.
