BY-LAW ULTRA VIRES
DANCE HELD GN SUNDAY MAGISTRATE’S RULING (Per Press Association.) WELLINGTON, this day. Giving reserved judgment in a case in which the proprietor of the Majestic Cabaret was charged with using a dance hall on a Sunday following the hiring of the premises by the Thirty-Three Club for a subscription dance which continued until 2 a.m. on the -Sunday morning, the magistrate, Mr. J. H. Luxford, S.M., held that the by-law is ultra vires. He said, 'the, information' mush also be dismissed because the effect of onie clause was to enforce Sunday observance; in other words, the observance of the Fourth Commandment and the Legislature had prohibited municipal councils from' making by-laws to enforce the observance Or performance of religious or moral duties.
