NOT AN ACT OF DRIVING

OPENING DOOR OF CAR TARANAKI CHARGE FAILS INJURY TO A CYCLIST (Per Press Association.) NEW PLYMOUTH, this day. Holding that the opening of a motor car door had nothing to do with the driving of the vehicle, Mr. W. H. Woodward. S.M., gave a reserved judgment yesterday and dismissed a charge against Frank Collins o! driving without reasonable consideration for other persons using the road. When he parked his car Collins opened a door on the side farthest from the footpath with the result that a cvcildst ran into it.

The section of the Motor Vehicles Act under which the charge was laid was-a penal one and should not be held ito mean more than it did mean, commented the magistrate. He pointed out that a door of a car could be opened by a person other than the driver and under circumstances in which the car could not be held to be driven.
