GREY MAGISTRATE’S COURT.

Monday, November 18th.

(Before R. S. Hawkins, Esq., S.M.)

G. Perotti v. Young Hee. Claim for £3 16i 3d for timber supplied. Mr Wake for plaintiff and Mr Joyce for defendant.

A. Perotti said that his father gave him a written order from Young Hee for timber. The articles were entered in the book and the drayman got a duplicate to get signed. He saw an order which began "Please deliver to Cemetery ” which he took to mean it was for Young Hee. He gave a copy of order to the yardman.

By Mr Joyce—Luk Guan went to his Jiouse and asked for the account for timber. Witness told him it was down to Young Hee. He, however, gave the account.

P. Power gave evidence that he received the order from Perotti for Young Hee to supply timber to Cemetery which he did. He did not get the book signed till the second lot was sent. For the defence Mr Joyce called Young. Hee, who said that a Chinaman asked him to write an order out in English which he did and gave it back to the Chinaman. He did a good many orders for his countrymen. He never signed his name by the typewriter; for his own orders he signed his name.

By Mr Wake—When the order left him it. was signed. Tuk Gram said he was going to give the order to Perotti. Tub Quom, a Chinaman, also gave evidence.

The Magistrate gave judgment for defendant.

Grey County v. D. Larkin.—•Claim for rates due. Mr Hannan for plaintiff. Judgment by default with costs.

Fletcher and Warren v. Brossan.—The latter was indebted to the former, who sought to practically levy upon Brossan’s Old Age Pension. The Magistrate held that this could not he done, Old Age Pension being inalienable, and gave judgment for defendant.
