The Appeal Court, in the case of Blunden v. the Oxford Road District, by its judgment, in allowing the appeal, lays down the important principle that where the local body authorises the construction of a work, bona fide believing it to be within the Statutory powers, it will be liable as for a tort to anyone sustaining damage by reason of construction of such work cannot avoid responsibility on the ground that its acts were ultra vires, and therefore unauthorised.
