The Appeal Court, in the case of Blunden v. the Oxford Road District, by its judgment, in allowing the appeal, lays down the important principle that where the local body authorises the construction of a work, bona fide believing it to be within the Statutory powers, it will be liable as for a tort to anyone sustaining damage by reason of construction of such work cannot avoid responsibility on the ground that its acts were ultra vires, and therefore unauthorised. Drowned During a Flood. Dunedin, November 4. A man named Cox was found drowned at Happy A r alley. He was supposed to be looking for his hcrse during the flood. The Presbyterian Assembly. At the Presbyterian Assembly to-day the Moderator left the chair during the discussion of the' motion moved by the Rev. Dawson, that the dress worn by the Moderator of this Assembly be dispensed with in future. A heated discussion followed, the Eev. Cameron going so -far as to say that no Assembly should dictate to him what dress he should wear. If itdidhe would defy the Assembly. Various amendments to the motion were moved, and the Rev. Hewitson moved the previous question which was carried. Run Over by a Cart. Chkistchurch, November 5.
A two and a half year old son of Constable Lewin was run over and killed by a cart last night.
