KUMARA MAGISTRATE’S COURT.

(Before Messrs Aitken and Benyon, J’s.P.)

George M'Loud was charged with committing a breach of the peace. Inspector McDonnell appeared for the police. Accused pleaded guilty, and was convicted and discharged, and ordered to pay 14s costs.

Alexander .Waters laid a complaint against Gregory Henham that the latter was likely to commit a breach of his bond. Mr T. V. Byrne, on behalf of A. Waters, asked to be released from his bend as a surety for the proper behaviour of Gregory Henham. Defendant called could not give any reason why Mr Waters should be relieved) of his bond. The Bench decided that they had no dower to release the surety, but expressed the opinion that had they the power they would grant the release asked for in this case.

Gregory Henham was charged with using threatening language to one Annie Milson. Inspector M'Donnell appeared on behalf of the police, and Mr T, V. Byrne for accused. Before pleading Mr Byrne, on behalf of accused, asked if the Bench would express an opinion that, in the event of conviction, they would discharge accused on his promising to leave the district. The Inspector opposed the application unless accused promised to go sufficiently far away, say out of the Island or out of the colony altogether. The Bench stated that if ace ised pleaded guilty on both charges, they would convict and discharge him on condition that he leave the district b.fore Friday evening, and not come within a 50-mile radius for twelve months, or on committing a breach of this condition the Court will inflict the utmost penalty of the law. Costs amounting to 25s against accused were awarded.
