GREY MAGISTRATE’S COURT.

Monday, September 23rd.

(Before E. S. Hawkins Esq., S.M.) CIVIL CASES. Leviathan Freehold Gold Dredging Company v. E. V. Smith. Claim for £9O for overdue calls. E.A. Wickes, secretary of the company gave evidence as to defendant being on the share register and to the making of the calls. Judgement was given for the plaintiff company for amount claimed with costs. Same v. D. Murray. Claim for £2l 5s for overdue calls. E. A. Wickes gave similar evidence as in the first case. Judgement was given for amount claimed with costs.

Mr Wake appeared in both of the above cases for plaintiff. Shellback Gold Dredging Company v. J, Booth. Claim for £2l 5s for overdue calls. Mr Hannan for plaintiff, and Mr Joyce for defendant. J. L. Doogan, secretary, gave evidence as to Booth being on share registrar and to the making of the calls. By Mr Joyce—The notice of call was sent the day following the meeting' at which it was struck. Witness had received no transfer of defendant’s shares from Sligo Bros. Mr Joyce for the defendant contended that on the second call the necessary 21 days notice had not been given, while with the third and fourth calls only 20 clear days notice was given.

The Magistrate struck out the second, third and fourth calls and gave judgment for balah'ce, £lO. Same v S Dawn, Claim for £IOB for overdue calls. Judgment by default for amount claimed with costs.

Prohibition order was granted againsi J. Watson.
