Before the full Court Mack, on behalf of Mrs Jane Smith, applied for a rule nisi citing the publisher of the Daily Telegraph to show cause why it should not be attached for contempt for publishing a statement calculated to interfere with the due course of justice and prejudice her in the eyes of the public in connection with the late trial.
Similar applications were made regarding the Sunday Times, Australian Star, and Newcastle Morning Herald. [Rules were granted, returnable on Friday. The Daily Telegraph was cited for publishing a cable from Wellington forcasting; fresh evidence in the Taluno case and others for commenting on the disagreement of the jury in stating that seven jurors were for and five against.
