A WRIT OF FIERI CAPIAS.

Dunedin, April 21. H. J. Tv. Massey-Lawless appeared before the Supremo Court to-day under a writ of fieri capais. Defendant went bail for a man named While, who absconded prior to the last criminal sitting, and having failed to pay the £IOO bail was arresteft and detained in custody. A. R. Barclay, for defendant, contended that the act and form of the writ did not authorise the detaining further of Lawless in custody. The writ was entirely unknown in English law.
Justice Williams said that as far as he knew this was the first time the question had been raised, and he thought that the matter should stand over for the day to enable (ho Crown to investigate the facts. He presumed that the Crown would not he able to detain defendant if he really had no means of paying the debt, but the question must be considered if defendant could bo further dealt with if released under tire writ. The case was therefore ordered to stand over for the day.
