GREY MAGISTRATE’S COURT.

.1. Meagher v Executor in the estate of J. Gibblin, deceased. Claim for £123 monies lent. Mr Hannan for plaintiff and Mr Guinness for defendant. The following additional evidence was given A. E. Guinness: —The morning following Gibblin’s death, I went over and placed a man in charge and opened the safe, and found the watches and £5 in gold and silver. There were no cheques in the safe. Witness also produced all tin books found on the premises and stated that after thoroughly searching the same ho found no entries or wages due or paid to Meagher. In cross-examination by Mr Hannan witness stated that by books of deceased it was apparent that ho paid most of his bills in cash. J. Meagher, who had been served with a subpuma in order to get the original book, stated that ho could not find it. He had not been in the hut for four months previous. Witness swore positively that it was an exact copy of the original that he had produced. His Worship after reviewing the evidence gave judgement for defendant with costs.
Legal argument was then proceeded with in the Warden’s Court in the application of Claughesoy for a special claim at Nelson Creek. Objected to by IIWiek. Mr Hannan for applicant and Guinness for objector.
