Patrick Convery v John Harris —The defendant was chargod on the information of Patrick Convery with assault on February 25th, 1900, at Dillmanstown. Mr T. V. Byrne appeared for plaintiff. There was no appearance of defendant. Patrick Convery sworn —said, I am a blacksmith residing at Dillmanstown, On the date mentioned, John Harris came to my shop and asked me to shoe his and effect some repairs to his cart. Subsequently ho returned and abused me. I advised him to go homo. I then returned to the shop and continued my work. Harris came behind mo and assaulted me. I appealed to him to resist but to no purpose. He got mo down when two men came and relieved me. About 20 minutes after Harris again returnsd and abused me asking mo to come out and fight him. Subsequently I caused a letter to bo written to him asking him to apologise and I would stay all proceedings, Ho refused. Fined 103 and costs of court 183, witnesses 15s, counsels fee 10s 6d, in all £2 13 6d. New Zealand Clothing Factory v. Samuel Lee, claim for £1 17s 6d. Judgmsnt for amount with costs 63. C. Tverson v. M. Murphy, claim f >r £l2 15. Mr Byrne appeared for defendant and stated that there was a set off on on the part of his client amounting to l'Js 6d. He raised a preliminary

objection which was allowed by His Worship, but on further consideration defendant decided to waive the point and go on with the case. C. Iver3on called, sworn, said ho was employed by Mr Murphy at 15s per week with board and lodging for 17 weeks. Two days after further evidence win heard. Judgement for counter claim was allowed to amount of £i 19) Od wi-.h costs (is and 103 6d couns-.d fees.
