That the Shellback Creek Gold Dredging Company are plaintiffs in the above suit for the cancellation of water race license, numbered 3655, dated 15th November, 1899, in the name of the above named defendants on the grounds that the said water race has been entirely unused, unoccupied, neglected and abandoned for the space or period of titno of three years last past by the said defendants or by any persons on their behalf. 2. That the said water race has become liable to forfeiture and said license therc--1 fore liable to cancellation. 3. lhat the above named Company have been unable to servo the defendants with summonses personally in consequence of having left the district and i their whereabout not known and cannot be found. 4.
