That the Shellback Creek Gold Dredging Company are plaintiffs in the above suit for the cancellation of water race license, numbered J 035, dated loth November, 1899, in the name of the above named defendants on the grounds that the said water race has been entirely unused, unoccupied, neglected and abandoned for the space or period of time of years last past by the said defendants or by any persons on their behalf. 2. That the said water race has become liable to forfeiture and said license therefore liable to cancellation.
