In order to prevent any mistake as to tiie legality of impounding cattle in places where insufficient shelter is provided, for the benefit of our Takaka friend; we quote tiie 30th Section of the Act of 1331. ft shall not be lawful for the local authority to notify any place as a Public Pound, unless and until the same shall be properly fenced and enclosed and provided with sufficient, means of shelter for the animals impounded therein, and adapted so far as may he, for keeping cattle infected with any contagious or infectious di>ea e separate and apart from other cattle.

Every poundkeeper shall, within four

months after the commencement of this Act, provide sufficient means of shelter in the pound kept by him for the animals impounded therein, and otherwise provide that such pound shall be arranged in manner as required by this Act &c. Ac, aid any Poundxeeper failing or neglecting to comply with this provision shall be hable to a penalty not exceeding five pound

As the Impounding Act came into

force on the Ist of January, in this year the four months alluded to has now elapsed, and as neither of the Pounds in Takaka and Rockville is provided with any shelter whatever, no animal can be legally impounded and any persons charged with poundage fees for animals pounded in either place would he quite justified in refusing to pay the amount. We imagine that the reading of this Act has been misinterpreted by the members of both local bodies wno are evidently under the impression that shelter has to be provided by their respective Board.- - . This is not the case, as it distinct]}' states that the ‘Poundkeeper’ snail provide the shelter, the cost of which may be defrayed by him oit of such portion of the Pound fees as should be payed by him to the District Fund, and in the event of his not complying with this, he is liable to be fined as above mentioned.
