Mr Ward's Seat.
(Per Press Association.) Wellington, This Day. The case under the Awahrua Seat Enquiry Act, 1897, is being argued before the full Court of Appeal to-day. The Act empowers and directs the Court of Appeal to determine whether under the existing law and upon the facts set out in the Act the seat of the Member of Awarua has become vacant, and if so on what date the vacancy occurred. On the case being called on Mr Theo. Cooper stated that he, and Mr Skerrct with him, appeared for the member for Awarua. Mr Gully appeared as counsel nominated by the Speaker. Mr Gully at the outset made a statement that it was obvious that the House, having delegated its functions to the Court, stood impartial in the matter, but that as the Act seemed to contemplate that he should advance arguments against the rights of Mr Ward to hold the seat, he should do so after counsel for Mr Ward had been heard. Mr Cooper then commenced his address to the Court on behalf of Mr Ward.
