Feilding S.M. Court.
♦ Friday, July 17. (Before R. L. Stanford, S.M.) The following cases were dealt with after we went to press yesterday : — Hubn«r Bros. v. W. S. Poole ; claim £2 17s. Mr Sandilands for plaintiff and Mr Richmond for defendant. This was a claim for an amount alleged to be due on a contract for building a cottage. The defence was that the whole amount (LI 48) had been paid excepting 17s. A receipt for L 2 (the amount in dispute) was produced and plaintiff alleged this was paid on account of certain extras and not on the principal contract. Judgment for amount claimed with costs ll«j and solicitor's fee 265. The evidence for the defence was taken in the case Bell, Gully and Izard v. J. R. Anderson; claim .£lO 11s 3d. Mr Baker appeared for the plaintiffs and Mr Sandilands for defeudaut. The de- j fence was a denial of liability, and de- J fendant and G. M. Benson were exam- i ined, the former alleging that Captain Whitney was liable for tbe amount. j The Court then adjourned.
