Stock Sales. The following very interesting decision is quoted in the Manawatu Standard of this morning, from a Home paper : — " A case of considerable importance to many in the stock world has just been decided in the Portsmouth County Court by Judge Leonard. The action was brought by the Fareham Market Company against Henry HoliI day for damages of breach of contract, and Mr Burnside, who opened the case for the plaintiffs, said that although the amount at stake was small, the question involved was of great consequence. On : July Ist defendant sent some beasts to the market and entered them for sale by auction ; but before the sale came off he took them away, remarking that he did not think there were any likely buy- i ers there. Subsequently the company discovered that the defendant had sold : the beasts privately in the market, and they now claimed commission on the sale, in accordance with their established rules. The defence was that j there was no contract between the par- ; ties, and the only charge to which the < company was entitled was threepence i for each beast, the fee charged for un- '. sold cattle. After hearing the evidence : His Honor found for the plaintiff com- ; pany, with costs, remarking that it ! would be monstrous if such practices were allowed to go unchecked.
